Membership Agreement

This Membership Agreement (the “Agreement”) is entered into between Lagniappe Fitness & Recovery, LLC (the “Gym”) and the undersigned individual (the “Member”). By enrolling and submitting payment, the Member agrees to all terms, conditions, policies, and rules outlined below.

1. Member Information

3. Membership Dues & Billing

• Membership fees are billed at {membership_fees} per {membership_recurrence}.

• Payments are automatically drafted from the payment method on file on the same day each billing cycle, beginning on the Start Date.

• The Member is responsible for maintaining a valid payment method at all times.

4. Cancellation & Commitment Policies

A. No-Commitment Membership

• Notice Requirement: A written cancellation notice of 28 days (4 weeks) is required.

• How to Cancel: Through the Member Portal ({login_link}) or by emailing hello@lagniappe-fitness.com.

• Billing During Notice Period: Membership dues remain the Member’s responsibility during the 28-day notice period.

• Failure to Provide Notice: A $100 cancellation fee will apply.

B. One-Year Membership Contract

• Commitment Term: 12 months.

• Early Termination Fee: $250 if canceled before completion of the contract term.

• Renewal: Automatically converts to month-to-month after the initial 12 months unless a 28-day written cancellation notice is submitted prior to renewal.

C. Two-Year Membership Contract

• Commitment Term: 24 months.

• Early Termination Fee: $300 if canceled before completion of the contract term.

• Renewal: Automatically converts to month-to-month after the initial 24 months unless a 28-day written cancellation notice is submitted prior to renewal.

D. Insurance or Medicare Memberships

• No cancellation fees apply.

• Members must utilize the facility a minimum of:

  • 10 visits per calendar month, or

  • 12 visits per calendar month for Union Pacific insurance participants.

5. Insufficient Funds & Late Payments

• If a payment fails, the Gym will reattempt the charge daily until payment is received.

• The Member will be notified of any failed payment.

• A $15 late fee will be applied to payments more than 7 days past due.

• Gym access will be suspended until the balance is paid in full.

• The Gym reserves the right to cancel the membership and send any outstanding balance to collections, including applicable cancellation fees.

6. Annual Maintenance Fee

An annual maintenance fee of $50 will be billed on May 1 each year for one-year and two-year bi-weekly memberships to support facility upkeep and improvements.

7. Member Portal Access

Members may manage billing, update payment information, and submit cancellation requests through the Member Portal at {login_link}.

8. Membership Hold / Freeze Policy

Account freezes may be granted at the sole discretion of Gym management. Freeze terms, conditions, and duration will be determined on a case-by-case basis.

9. Code of Conduct

To maintain a safe and respectful environment, Members agree to:

• Treat staff and other members with respect

• Refrain from profanity or offensive language

• Wear appropriate attire at all times

• Wear shirts when outside locker rooms

Violation of conduct policies may result in suspension or termination of membership.

10. Health, Safety & Facility Rules

• Members acknowledge the inherent risks of physical activity and agree to exercise responsibly.

• All posted safety rules must be followed.

• Powdered chalk is prohibited; liquid chalk is permitted.

• Proper athletic attire and footwear are required at all times.

11. Liability Waiver & Assumption of Risk

The Member voluntarily assumes all risks associated with participation in fitness activities and releases Lagniappe Fitness & Recovery, LLC from any liability for injury, illness, or damages.

12. Unauthorized Training & Personal Training Policy

Members may not train, coach, or provide instruction to others without prior written approval from Gym management. Unauthorized training may result in fines, suspension, or termination of membership.

13. Age Verification & Misrepresentation

All Members and visitors must provide accurate age and date-of-birth information. Any falsification will result in immediate termination, forfeiture of fees paid, and removal from the premises.

14. Minor Access & Participation

Ages 13–15

• Must be accompanied by a legal parent or guardian at all times.

• Parent/guardian must actively participate.

• Minor must be included on a family membership.

Ages 16 and Up

• May access the facility independently.

• Must still be included on a family membership with a legal parent or guardian.

15. Electronic Communications Consent

The Member consents to receive notices, billing statements, updates, and promotional communications electronically. Electronic communication satisfies all legal notice requirements. The Member is responsible for keeping contact information current.

16. Changes to Terms

The Gym reserves the right to modify fees, services, or policies with 28 days’ notice to Members.

17. Termination by Gym

The Gym may terminate membership at the Member’s expense for policy violations, non-payment, misuse of facilities, or conduct deemed harmful to staff or members.

18. Governing Law

This Agreement is governed by the laws of the State of Texas. Any disputes shall be resolved in courts located in Hardin County, Texas.

Acknowledgment & Acceptance

By submitting this agreement and payment, the Member confirms that they have read, understood, and agreed to all terms and conditions herein. This Agreement becomes binding upon submission and payment. No physical signature from the Gym is required.
